It seems to me that failure to uphold the Constitution is a major failing in a president. Holding some poor thug in captivity, then throwing them in a brig seems to violate the core of the Constitution as I remember it. Then again, I'm not a lawyer. Announcing him guilty from the podium also violates one or two tenants of American law, and doing it because you don't have enough information to convict him even makes it worse. Impeachment suddenly starts looking like a great idea.

I agree the government is over stepping their boundary's, miss using their power by using one of their invented label, loop holes that shouldn't be valid in hoding a "bad guy," to side step the constitution. This seems a consistant pattern of Republicans and what I hate about them most. However, what is most frightening is I dismiss it and am use to it, neglegently accepting it as normal.

Finally got around to reading this editorial.

You know, I'd even let them get away with the "enemy combatant" ploy if it forced them to actually declare this "war" they've got going. Take that power back out of the Executive branch and put it in the Legislative where it belongs.

As NPR pointed out this morning, we have a foreign national accused of terrorist in federal court, and two American citizens locked up with no constitutional protections. Some justice department!
